If an alert border guard hadn't happen to notice that the guy was acting oddly, Ressam's plot would have succeeded. And the only thing rendering our Constitution "obsolete" are activist judges curtailing our rights to free speech and free practice of religion, as well as altering the very meaning of words to make "public use" mean "private benefit."
