If you go back and read, you’ll figure out what is going on. Apparently there is a terrorist suspect being tried. His lawyer filed a motion to see if any of the evidence against his client came from the NSA monitoring. If so, and if the monitoring was improper, the evidence used can’t be used in the trial.

Confusion abounds. But don’t let that stop you from lashing out at whatever injustices you perceive, no matter how wrong you are.

I leave open the possibility that the president may be able to have power to collect intel information but that may not be proper evidence for a criminal prosecution. I also leave open however, the possibility that in general the NSA program may have been lawful, there are specific situations we have not yet heard about that would make those specific pieces of evidence improper.

We don’t know what the evidence is or where it came from, so we really have no way of knowing. Hopefully the court will get to the bottom of it.
