After the implosion of the NSA wiretap issue, and this being an election year, Democrats wouldn't dare risk opposing it. In point of fact, the only reason they were opposing it was they believed they could get political traction by slamming it and appearing to be concerned about civil rights (appearing being the operative term). When it became apparent it wouldn't help, and would probably hurt, their political chances, they flip-flopped. Which is what people who view everything as "what do I have to do to get/stay in power" as opposed to "what do I believe is right and correct" do. Well, of course it passed.
