I knew from the very first article on WRAL that this Act was more Leftist feel-good stupidity run amuck. In Raleigh we recently had a bank robbed for the SECOND time by thee same man and RPD knew pretty much where to go find him. Until we finally begin holding folks accountable then we will continue to suffer,

It was a long read….and I have to admit I skimmed through it. But I agree with your sentiment. The legal system has been skewed to allow habitual offenders to go free and sometimes an innocent individual will be convicted. The main thing is that we are dealing with a purely human system that tries to be all things to all people instead of arbiter of facts and deals in realities. I am sorry that there is a disproportionate number of minorities convicted in our system. But, society as a whole did not determine they would be criminals, they did. Society as a whole did not stop them from becoming educated or skilled in a trade that would be of benefit to all, they decided not to take part in the free educational opportunities that exist for 12 years of their lives and they also decided that other things like taking drugs or becoming part of a gang was more important. They chose parts of society that would not benefit them.

So in this convoluted and distorted world of legal power plays we have this particular law. If I was a judge and a defendant and his lawyer presented this to me at the time of his sentencing to life or death, perhaps I would consider it and this would be my sentence: Life in prison with stipulations….Solitary confinement with no contact with other prisoners. Then I would not allow him TV/video games/movies…as it has been proven these cause people to become violent and act out. Low calorie/no fat/no salt meals/low or no sugar meals. Mandatory Exercise periods of not less than 1 hour a day…no weight lifting, but a cardiovascular routine to keep hearts healthy. One book to read: The Bible. One phone call a week to relatives only.

Then I would say have a great life.

The Racial Justice Act sounds like another member of the Fuzzy Justice family. “Social Justice,” “No Justice, No Peace,” and their cousins “Save the Whale (Whatever)” promote the interests of some at the expense of others.
Philosophers (and sophists) can debate the existence of good and evil. The US Government was created, by consent of the governed, to “establish justice…” etc. Criminal Justice is deliberately limited by constitutional amendments. By proscribing conduct deemed harmful to public order and assigning sanctions, government has served notice that causing injury has consequences. When an offender is found guilty beyond a reasonable doubt, justice requires that the sanction provided by the legislature be applied.
If the legislature has a problem with any sanction, they should be honest enough to debate their concerns, vote their conscience, and take their chances with the voters.. This act abdicates their responsibility to their constituents and rejects the rule of law by allowing an individual judge to determine who shall live and who shall die. That is a total miscarriage of justice.

I’m glad you revisited this issue-its the first exposure I’ve had to it. After having read the intensively-prepared article on the SBI/FBI/Capital Punishment ballyhoo, I was an easy reader “capture” for another well-thought out composition.
Because it reflects my concern(s) for the growing segregation of America, through the tools of “diversity”, “tolerance” and principles of multiculturalism, I forwarded it to my local NC House Representative as well as the only sensitive Senator’s ear for their use in understanding their constituency.
Thank you for the time and energy you put into the article. It was worth it to me.
