The real fault lies in the political correctness or, more accurately, political cowardice surrounding this. Having spent four years in the US Navy (68-72), this new policy of cramming young men and women into close quarters together is the root of the problem. The thought of women on board a ship used to be unheard of; and “sexual assault” cases were near non-existent.

People are like horses; you pack too many into tight quarters with one another and there will be kicking, squealing, biting, and other forms of physical interaction.

The President occupies a unique position in military law enforcement. As Commander-in-Chief, he is the ultimate supervisor of all military prosecutors, just as he is the chief federal law enforcement officer, through control of the federal Department of Justice. In the civilian system, the judiciary is completely separate, and not under the authority of the President; the lifetime tenure for federal judges was meant to insulate them from political pressure. But in the military, the judges are military officers, who are subject to the orders of the Commander-in-Chief. The President’s statements can be taken as the Commander-in-Chief ordering military judges to impose particular sentences.

Not even addressed in this is the fact that the jurors in the military justice system are also servicemen, are also subject to the orders of the Commander-in-Chief. It could be argued, and I would guess it will be argued, by defense attorneys, that the Commander-in-Chief has tainted the entire jury pool, that the President has, in effect, ordered convictions.

The President’s attempt to influence the jury pool in the Martin/Zimmerman trial hopefully will amount to zero for the reasons listed by Dana, except that in Florida there are a lot of Dear Leader worshipers that hang on his every utterance, especially the stupid ones.

I hope the military judge, if the servicemen are found guilty, throws the case out the window and lets the men walk free with honorable discharges. They will screw up again because that’s what people who commit such crimes do, and they will be tried in civilian court, insulated from people like our Idiot-in-Chief. At that point they will have years to reconsider the paths their lives have taken.
