It’s not Albany, New York, but the big cities in the state – Buffalo and New York City. I came up with the same headline, btw.
Also, check out the comments my co-blogger Legalbgl left that one of the deaths Kreuger uses was a friend of ours who was killed because a driver was speeding.
If someone is killed, and has an iPod on them, perhaps the law should recognize that as a mitigation for the other person. Sort of like making helmet-less motorcycle riders who are in accidents %100 responsible for all of their medical, etc. bills. No helmet? The state won’t pay for a bandaid! Carrying an iPod and get run over? Tough noogies!
I don’t want anybody saying, “you can’t do this, do that, carry this,” or whatever. It’s none of their business. Responsibility resides with the individual. Nobody else.
And I hope Californians start buying up as many incandescant light bulbs as possible.
If the government banned “stupidity” would liberalism be banned?

What the #*@! It is still illegal to jaywalk in all 5 boroughs of NYC, public intoxication is a crime still on the books; slipping-and-falling is encouraged though, as there are more lawyers in New York than cops, and the ambulance-chasing variety still get a third in any settlement!
I was tempted to save my ink on this one and not comment.
This morning this story made national news and every tv station. Along with about 2-3 other stories. I think one of them was about the astronut and the lust in space thing.
We have 300 million plus people in this country with lots of stuff going on. Can’t I get news other than this? Every channel just ran these same stories over and over.
And then there’s the entertainment channel which somehow gets blended into national news. Who really cares what Lindsay Lohan is doing?
This is insane. It’s not the government’s place to protect me from myself. If I get hit by a car because I’m listening to my ipod then that’s my own fault. I can understand the ‘no cell phones while driving’ law. That law protects others that may be hurt by my actions. Sure, we can’t tell a woman what to do with her body but the government can interfere in our lives for the good of ourselvs. Grr. Why are we paying these politicians to come up with stupid crap like this? They need to confront other issues that are more important… like why does Nancy Pelosi get a huge plane!
benning, I think you have it right.
I’d take it a step further though. I’d have the motorist given the opportunity to sue the pedestrian for damages for causing the accident, by allowing oneself to be distracted while interacting with motor vehicles in a public thoroughfare.
