Breaking: SCOTUS hands major victory to gun rights advocates

Via Fox News:

In its second major ruling on gun rights in three years, the Supreme Court Monday extended the federally protected right to keep and bear arms to all 50 states. The decision will be hailed by gun rights advocates and comes over the opposition of gun control groups, the city of Chicago and four justices.

Justice Samuel Alito wrote for the five justice majority saying “the right to keep and bear arms must be regarded as a substantive guarantee, not a prohibition that could be ignored so long as the States legislated in an evenhanded manner.”

The ruling builds upon the Court’s 2008 decision in D.C. v. Heller that invalidated the handgun ban in the nation’s capital. More importantly, that decision held that the Second Amendment right to keep and bear arms was a right the Founders specifically delegated to individuals. The justices affirmed that decision and extended its reach to the 50 states. Today’s ruling also invalidates Chicago’s handgun ban.

Make sure to check SCOTUSblog for more details about the decision. Right now the site is slow-loading, I assume because of the gun rights ruling and also because of Elena Kagan’s SCOTUS confirmation hearings, which are scheduled to start around 12:30 ET today. Make sure to check in to the Volokh Conspiracy for their analysis of the SCOTUS ruling here.

  1. Headline: Obama Invalidates Supreme Court For Following Constitution

If there’s one thing he can’t stand, it’s being told that he’s wrong in his “specialty,” the Constitution. After all, he IS the president and he DID “teach” Constitutional law. How could he possibly be wrong?

  3. We have an individual right to defend ourselves. The SCOTUS has ruled in the past that law enforcement officers are responsible to defend members of society in general, not individuals in particular. When there is forced entry at your home, hold your handgun in your strong hand, as you dial 911 with your weak one!

  4. Guns do not have righs. Citizens have rights. The Supreme Court opined that free citizens have the right to bear arms where ever they may travel,

As for Dim Won, Barack Obama. I doubt he ever read the Constitution, much less taught it. The only picture i have seen of ObamA as a college lecturer shows him teaching not the Constitution but rather Allinsky. For all I can tell, Obama thinks Allinsky is the Constitution.

  5. I am just honestly glad to see the general public slowly shifting from unaware to aware. Seriously… what happens when all of a sudden there is a Civil Police Force (funny that sounds strangely fascist) but no armed civilians. A scary thought indeed.

  6. There is a gentleman here in PA who might still be alive today had he had a handgun when he went to the aid of neighbors who were being stabbed to death….he was killed trying to help! That killer had been convicted of stabbing and killing another man 20 years previously and was out on parole!

Now four people have died. This makes it clear that a handgun in the right hands could preserve life, not just take it.

I sincerely hope the SCOTUS sits out the next SOTU. [-(

  9. It is a pleasure to see the public come to its senses. It seems like such a rare occasion nowadays.

  10. So funny!!!!!!!!!! Hey, it’s a fundamental right laid out in our founding–what doesn’t The Annointed One understand about that?????? I ask again, what will it take for his slobbering fans to wake up and finally smell the coffee?
