Here is some historical perspective on how feckless Obhammud really is regarding the Benghazi prisoner (as if further proof were necessary):

During WWII Nazi Abwehr (military intelligence) hatched a caper called “Operation Pastorius” in which two four-man teams of saboteurs were inserted on the East Coast, one at NJ the other off FL. Two of the participants quickly realized the futility and tipped off the FBI who promptly arrested all eight.

FDR did not want to use the civilian court system because he thought it would give the appearance of going soft on these criminals. Later that same year, the SC ruled in a case styled “Ex Parte Quirin”(’42) that the President had the legal authority to opt for a tribunal.

It was convened in DC and the two perps who cooperated were given lengthy sentences and then deported well after the war was over. The other six died in the electric chair at Sing Sing Prison.

The law used in this case is still on the books.

Wikipedia gives this a passable treatment but the best is in an old book, still available, entitled “They Came To Kill” by Rachlis.
