North Carolina state bar files ethics complaint against Durham DA Mike Nifong

The AP has the story:

The North Carolina bar filed an ethics complaint Thursday against the prosecutor in the Duke lacrosse case, accusing him of breaking four rules of professional conduct when speaking to the reporters about the sensational case.
The punishment for ethics violations can range from admonishment to disbarment.

Among the rules District Attorney Mike Nifong was accused of violating was a prohibition against making comments “that have a substantial likelihood of heightening public comdemnation of the accuser.”

Stay tuned to KC Johnson at the Durham in Wonderland blog, who writes in his latest post:

This complaint involves solely the procedurally improper public statements; it’s entirely possible that there could be more to come.

All things considered, I certainly hope so.

      This is a huge rebuke — and my (unfortunate) guess is that Mr Nifong will not step aside. He’s dug in his heels on a very bad case, and has really left himself no out.

      Best guess: the judge will dismiss all of the charges at the February hearing, because he’ll really have no choice. Mr Nifong will not be able to prosecute the case personally, and no one in his office will be willing to take this case on assignment.

      Why have we not read of any civil action being contemplated by the parents of the lacross team at Duke and the former coach against the University? they reacted by destroying these young mens college experience and their athletic season, not to mention in the coaches case his job. I would think they would have a serious cause of action against Duke and the President.

      Earl, I’m not a big fan of putting $$$ into pockets of attorneys, but I hope the accused players sue the pants off Mr. Nifong and Duke University.

      First Nifong,now the “accuser” needs to be invesigated to establish if she lied about the rape. If she did she should be charged. I believe obstruction of justice is the usual charge when people fasly report a crime. Oh, she should probably return that scholarship to Jesse Jackson.

      Nifong put both feet in quicksand, and any “if I knew then what I know now” talk on his part will just make him sink faster. The North Carolina Bar Association should just pull the plug, as an example to over-zealous prosecutors everywhere.

      I don’t see that Duke University had any choice other than to respond as it did; even if the charges turned out to be false, you just can’t have accused rapists out representing the university. That sucks, but that’s life.

      Regrettable as it is to say in this case, had I been the president of Duke, I’d have suspended the players as well, simply because there was no other choice.

      I’m guessing that if the case ever does go to trial, Mr. Nifong will not be the one prosecuting it.

      Nor should he be.

      And in related news: I note that the New York Times, which started its coverage back in the day by referring to She Who Accuses as a “dancer,” and then revised the terminolgoy to “exotic dancer,” has of late decided upon “stripper.” Ho. ho.

      I was just wondering if Jesse and Al will return to North Carolina and hold a protest rally for the three lacrosse players falsely accused. Hasn’t Al Sharpton been through a false accusation before????

      I tell ya what is shocking me. Sev and Tommy are in agreement. Granted Tommy’s insightful comment was pretty accurate, so I guess I am in agreement also. OMG Turn you heads to the east folks, I am certain Jesus is comin’ back right now. – Lorica =))

      Vet, Yes he was. He accused a wealthy white male of raping a poor young black girl. Hmmmmm More things change, the more they stay the same. You can expect the Reverends to be in NC any minute now. – Lorica

      I guess I better not ruin it and bring up the electric car again. What was it called? The Tesla Roadster?

      At least Rev. Al had the good sense to talk with the accuser so he could later claim he believed she was telling the truth.
      The DA is supposed to act upon “probable cause,” supported by “oath or affirmation.” If there is no physical evidence to link the accused with the accuser, and the DA claims he did not converse with the accusor, how did he get the indictment past a judge?
