Elena Kagan’s SCOTUS confirmation hearings

Solicitor General Elena Kagan’s SCOTUS confirmation hearings are underway. I won’t be able to liveblog any of it, but as usual, SCOTUSblog has that base covered. And, of course, C-SPAN has a live video feed of the hearings.

Hi Sister..I just listened to a few of the preliminary remarks, but it appears that Sessions and Hatch will come down hard on the side of her not having judicial/legal experience and her extensive background in politics and policy making over actual legal experience in a courtroom. They asserted their concern over activism from the bench versus deciding law based on constitutional standards.

I was impressed and hopeful that they will squirrel out all the intricacies of the court that she may be unable to handle.

On the other hand…I felt the Democrats were short on substance and long on platitudes….does this portend a very contested hearing? If anything, the Republicans on the committee seem not to want to shirk their responsibility to the American people in exposing a potential pol on the bench and not a truly objective judge.

Elena Kagan is at least as qualified (but not more so) as Harriet Myers was.

Day two of the “hearings”. I’ve just caught comments here and there, and others’ comments.

Seems as though when the process is to confirm a conservative, digging deep is exactly what’s called for and don’t stop.

Confirming her, however, is totally different. Don’t ask me tough questions and you’ll get straight answers, but start digging and I’ll be more elusive, opaque and dishonest than my present boss, so lay off.

We all know she believes in the Constitution. She just believes it needs to be thoroughly updated and certain sections thrown out. You know, those pesky parts about “shall not be infringed upon” and all.
